Client Terms of Service
By booking with Explore One Media, you agree to the following:
Payment
A non-refundable 50% deposit is required to secure your booking. The remaining balance must be paid in full before any content is delivered or downloaded. All payments are final, Explore One Media does not offer any refunds. Invoices not paid within 7 days of the due date may incur a late fee of 1.5% per month (or the maximum amount permitted by law). Explore One Media reserves the right to suspend current or future services until all outstanding balances have been paid.
Rescheduling & Cancellations
Appointments may be rescheduled with at least 24 hours’ notice at no cost.
Less than 24 hours’ notice: $150 reschedule fee
Same-day or on-site cancellations: $250 cancellation fee
Appointment times are approximate. While every effort is made to arrive on schedule, delays due to traffic, previous appointments, weather, or other unforeseen circumstances may occur.
Turnaround Times
Our standard turnaround times are:
Photos: ~2 business days
Video/Reels: ~1 week
YouTube/Long-form: ~2 weeks
Turnaround times may vary slightly depending on project scope, workload, revisions, or unforeseen production delays.
Revisions
One round of revisions is included with all video services.
Additional revisions: $50 minimum
Music selections are final once editing begins. Song changes may incur a revision fee.
Requests that substantially change the original creative direction after editing has begun may be billed at an additional cost.
Travel
Travel within 30 miles is included. Projects beyond this range may incur additional travel fees based on distance. Any required parking, valet, tolls, permits, or access fees incurred during the project will be added to the final invoice.
Property & Shoot Readiness
The property or filming location must be clean, staged, and ready at the time of the shoot. Clients are responsible for securing pets, providing all required access information, obtaining permission to photograph or film the property, and ensuring the property is safe and ready upon arrival. Delays caused by lack of access or an unprepared property may reduce the scope of the shoot and may require an additional fee or rescheduling.
Explore One Media is not responsible for limitations caused by the property's condition, lighting, weather, occupancy, or environmental factors present during production.
Branding Shoots (On-Camera & Content Preparation)
For branding and on-camera content, clients are responsible for arriving prepared and camera-ready. This includes appropriate wardrobe, grooming, and any planned talking points. While guidance and direction will be provided during the shoot, preparation directly impacts the quality and efficiency of the final content. Explore One Media is not responsible for missed content, reduced performance, or incomplete deliverables resulting from lack of preparation.
Reshoots
Reshoots are not included unless required due to an error on the part of Explore One Media. Additional shoots or return visits will be subject to a minimum fee.
Creative Control
Explore One Media retains full creative control over filming, editing style, shot selection, image selection, color grading, pacing, music selection (unless otherwise agreed), and final delivery in order to maintain consistent quality and brand standards.
Copyright, Usage & Licensing
All photographs, videos, and other media created by Explore One Media remain the intellectual property and copyright of Explore One Media.
Upon full payment, the client is granted a non-exclusive, non-transferable license to use the final delivered media for their own marketing and promotional purposes.
Media may not be sold, transferred, licensed, or shared with third parties (including other agents, builders, designers, stagers, photographers, marketing companies, or vendors) without prior written permission from Explore One Media.
Raw Files
Raw photos, raw video footage, audio files, project files, and other production assets are not included with any service and remain the exclusive property of Explore One Media unless otherwise agreed to in writing.
Portfolio & Marketing Rights
Explore One Media reserves the right to use any media created for portfolio purposes, social media, advertising, website content, marketing materials, competitions, and promotional use unless otherwise agreed to in writing before the project.
File Delivery & Storage
Final media will be delivered digitally and available for download for a limited time. Long-term storage is not guaranteed. Clients are responsible for downloading and backing up all delivered files upon receipt.
Media Review
Clients are responsible for reviewing all delivered media promptly. Any concerns or errors must be reported within 7 days of delivery. After this period, the project will be considered accepted.
Weather & Drone Services
If weather conditions are expected to negatively affect the quality of the project, Explore One Media may recommend rescheduling at least 24 hours in advance to avoid rescheduling fees.
Drone services are subject to FAA regulations, temporary flight restrictions, weather conditions, surrounding obstacles, and safe operating conditions.
If drone operations cannot be completed safely or legally, Explore One Media will not be held liable and alternative coverage may be provided when possible.
Safe Working Environment
Clients agree to provide a safe working environment for all Explore One Media team members. Explore One Media reserves the right to stop or cancel a shoot without liability if conditions are determined to be unsafe, hazardous, threatening, or otherwise unsuitable for production.
Marketing Results
Explore One Media makes no guarantee regarding property sales, lead generation, social media performance, marketing reach, engagement, or other business results resulting from the use of delivered media.
Force Majeure
Explore One Media is not liable for delays, cancellations, or inability to perform services due to circumstances beyond our reasonable control, including but not limited to weather, natural disasters, accidents, equipment failure, government restrictions, illness, labor disputes, internet or power outages, or other unforeseen events. In such cases, we will make reasonable efforts to reschedule the project at a mutually agreed upon time.
Liability
Explore One Media is not responsible for any damage, loss, injury, or issues related to the property, individuals, pets, or conditions present at the shoot location. Clients are responsible for securing the property and ensuring a safe environment for all parties involved. To the fullest extent permitted by law, Explore One Media shall not be liable for any indirect, incidental, special, consequential, or lost-profit damages, including but not limited to delays in listing, missed marketing opportunities, or business losses arising from the use or inability to use the delivered media.
Governing Law
These Terms of Service shall be governed by and interpreted under the laws of the State of Florida.
